A RESOLUTION ALLOWING THE WAIVER OF CHAPTER 152 SUBDIVISION REQUIREMENTS AND RECORDING OF SUBDIVIDED PROPERTY

Al Schmuck/Pat Widboom are requesting a waiver of subdivision requirements for a portion of the property north and west of the Schmuck Addition outside of Luverne's city limits. When the Schmuck Addition was previously platted, an 11’ wide sliver of property was not platted on the north side of the subdivision due to there being a discrepancy between the occupation line (existing fence) and the deed line. A portion of property between Randy Mulder’s property and the Schmuck Addition was not platted as the developer (Al Schmuck/Merlin Cleveringa) wanted to trade the unplatted property in exchange for a utility easement that would cross Randy Mulder’s property to the north. Since those conversations, the developer no longer wishes to acquire a utility easement from Randy Mulder and Al Schmuck/Pat Widboom would like to sell the 11’ sliver of property to Randy Mulder as well as the portion of property between the Schmuck Addition and Randy Mulder’s property.
