PROPOSED RESOLUTION

A RESOLUTION OF THE CITY OF LUVERNE CONCERNING DETACHMENT OF CERTAIN LAND PURSUANT TO MINN. STAT. § 414.06

body

The City of Luverne received a petition for detachment of property from the City signed by property owners David and Vicky Meyer. The only way to detach land that is part of a city is with the approval of the Municipal Boundary Adjustment Unit. To qualify, the land must be adjacent to the city's boundaries, rural in character, not developed for urban-residential, commercial or industrial purposes. The City does not provide the full array of city services to this property, such as water, sewer and storm sewer. Luverne Township has adopted a resolution in support of the petition for detachment. If the City also supports the petition for detachment, no hearing is necessary and the Chief Administrative Law Judge shall grant the petition. If the City opposes or remains neutral, a hearing would be held and the costs of the mediation and hearing would be split between the City and landowner. This detachment would not negatively affect the City, the City would be able to carry on the functions of government without undue hardship.
